A Federal Court judge said revelations that Canada’s spy service mishandled evidence in the terrorism case of a Syrian refugee is of “great concern to the court” and could affect the outcome of the case. The Canadian Security Intelligence Service admitted it failed to disclose evidence that a confidential informant was “deceptive” when answering questions. A second source cited in the government’s case against Hassan Almrei was not subjected to a lie-detector test, contrary to what the agency had claimed in court documents.

The Federal Court of Canada has ruled the search of a suspected terrorist’s home violated his constitutional rights and ordered the Canada Border Services Agency to return everything it seized. In a 24-page decision released Tuesday, Justice Simon Noel says the May 12 raid violated the charter rights of Mohamed Harkat, an Algerian refugee whom the Canadian Security Intelligence Service accuses of having ties to terrorist organizations.

OTTAWA–A federal judge has blasted a heavy-handed search by border agents of Mohamed Harkat’s home less than three weeks before the government’s case into deporting the alleged terror suspect was to be heard. “I just find the exercise went really far. Dogs? Explosives? Guns? … I just found the whole thing blew up. It appears out of proportion,†Justice Simon Noel told a federal lawyer yesterday.

OTTAWA — A Federal Court judge is raising questions about whether Canada’s spy agency has been withholding information and lying to the court in its effort to deport terrorist suspect Mohamed Harkat. In a toughly worded judgment released Wednesday, Justice Simon Noel said the “troubling situation” casts doubt on the good faith of the Canadian Security Intelligence Service.
