A senior immigration officer’s decision to deny permanent residency to a failed asylum seeker because of his links to a resistance movement in El Salvador did not take into account “exceptionally strong” humanitarian and compassionate reasons to let him stay, a federal judge has ruled in a case that activists say highlights how Canada’s laws can too easily peg someone as a security threat.

Jose Figueroa, who came to Canada as a refugee in 1997, was once a member of Frente Farabundo Marti para la Liberacion Nacional (FMLN) that opposed El Salvador’s former military regime. He helped recruit for the FMLN and organized meetings but was not involved in the armed struggle.

Court Support for Jose Figueroa Postponed

Posted by admin on Jun 26th, 2014

The Federal Court hearing scheduled for July 2 has been postponed due to the death of a different judge — the judge hearing Jose Figueroa’s case has flown east for the funeral.

We will let you know when the new date is set. When the hearing takes place, we will gather outside the court house again, and show our support for Jose Figueroa, who remains in sanctuary due to an unjust deportation order.

NOII statement (English / Punjabi ): Commemorating 100 years of the Komagata Maru

100 YEARS AGO the 376 passengers of Komagata Maru were refused entry into British Columbia by Canadian immigration officers. They experienced racism and hostility. Their inability to land caused hardship for the passengers, who soon lacked food and water, were denied access to medical attention, to communication with their family and to proper legal counsel.

As we commemorate this resilient journey and the determination of people, we honour their legacy including descendents who have persevered and established their lives here despite so many barriers. Now, 100 years later, the story of the Komogata Maru is being celebrated as an historical event that occurred at a time when “Our city looked very different”.

For many however, these changes are not evident.

Citizenship and Immigration Office Occupied

Posted by admin on Feb 12th, 2013

About 50 people occupy the Citizenship and Immigration buildings in Vancouver, Unceded Coast Salish Territories, seeking justice for refugee Hossein Blujani and demanding a public investigation in to the cause of his death.

The body of the 31-year-old Kurdish-Iranian refugee was found on December 1, 2012 on the railway tracks near Commercial Drive and Broadway in an apparent suicide. Blujani survived over 12 years of imprisonment, torture and forced labour in Iran and Iraq. When Blujani sought refuge in Canada he was faced with immediate detention and CBSA began to pursue unfounded allegations of him being a “security threat” and a member of a “terrorist” organization – an organization he was recruited into as a 15-year old and one which Canada itself has delisted. Blujani had appealed this decision and a Federal Court hearing was set for February 12th, 2013. However on February 8th, the Court dismissed the appeal due to his death.

No More Deaths, No More Deportations.
